This can be billed against as work is performed, or it may be returned to the client when it is not used. Retainer fees are common in hourly fee cases and in contingency fee cases.

A prevailing party’s fee is a calculation that determines the amount an attorney should be reimbursed for their work in a lawsuit. Typically, this figure is determined by using the attorney’s reasonable hourly rate, sometimes multiplied by a factor reflecting the risk or complexity of the case. In some jurisdictions, courts may award fees proportional to the amount of damages recovered.

Contingency fees

This fee structure gives lawyers an incentive to take on only cases they believe have merit. It also allows clients to access legal services without the financial burden of upfront fees. Depending on the case, the attorney’s percentage can range from one-third to 40% of the final court award or settlement. Attorneys may also deduct expenses from the total recovery. Regardless of the arrangement, it is important for clients to understand how the fees are calculated and agree upon them prior to signing an agreement.
